Sonic CD is coming out soon and we’re getting excited!

Since the announcement, we’ve been getting a really great response from our fans about both the upcoming release AND the new inclusion of the Japanese soundtrack. If you haven’t heard, a physical version of this soundtrack will be releasing soon, but only in Japan!

Fear not! There’s still a way to get your hands on this amazing piece of Sonic CD swag: We’re taking the game and soundtrack, rolling them together, and setting up a contest where you can win both!

To enter, we want your fan art inspired by Sonic CD! Grab your pens, paper, ink, paint, mice, and miscellaneous art products and recreate your favorite moments from the game for a chance to win this great package.

What can I win?

Glad you asked! We’re giving 50, yes 50 (!) prizes away! 50 Prizes in each territory!! So there really is no reason not to enter and try your luck at this contest. Here’s the breakdown:

How to Submit Your Art!

Ok, you know the prize, you know the contest, now you have to get us your art! To enter the contest, you’ll first need a piece of art themed to Sonic CD and be in either North America, United Kingdom, or Mexico (though, check the official rules to confirm you are eligible). Next simply submit your art to the following email addresses:

Official Rules

There is no purchase necessary to enter
or to win a prize.

1) Promotion Description: Sega of America, Inc. (“Sponsor”) is offering “Sonic CD™ Fan Art Contest” (“Promotion”) and will award prizes based on judging all eligible entries against the criteria established in these Official Promotion Rules. The Promotion begins at 9:00:00 AM US Pacific Time (“PT”) on November 11, 2011 and the deadline for submission of entries is 10:00:00 AM PT November 29, 2011, (“Submission Entry Period”).

2) Eligibility: Promotion is open to all legal residents of the fifty (50) United States, the District of Columbia (excluding Puerto Rico) and Canada (excluding Quebec), who are 13 years of age or older at the time of entry (“Entrants”). Employees, officers and directors of the Sponsor, its parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, (collectively “Promotion Entities”), their immediate families (parent, child, sibling & spouse) and persons living in the same households of such individuals (whether related or not), are not eligible to participate in the Promotion. Void in Puerto Rico, all other US territories, Quebec and where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.

3) Creating your Fan Art Submission: Create an original piece of art based on your favorite scene from Sonic CD™ (your “Fan Art Submission”). Your Fan Art Submission must: (a) be totally original, created by you, cannot be previously published or appear anywhere else and CANNOT contain any third party copyrighted material or otherwise infringe on the intellectual property or other rights of a third party; (b) be suitable for general audiences (i.e., may not be obscene or indecent, including but not limited to nudity, pornography, profanity or gratuitous violence); (c) not contain defamatory statements (including, but not limited to, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); (d) not include threats to any person, place, business, group or nation; (e) not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate any law or regulation.

4) How to Enter your Fan Art Submission: Send an e-mail to communityteam@sega.com and attach your Fan Art Submission as a file to the e-mail; in the body of the e-mail include the following informational points (your “Entry”):

• Your first and last name,
• Your age,
• Your state/province
• Your e-mail address
• Your telephone number including area code
• The name or reference for your Fan Art Submission

There is no limit to the number of different times you can enter, however, each Fan Art Submission must be new and completely different from any previous Entry you have submitted and each must be submitted as a separate e-mail Entry. There is a limit of one (1) prize per person.

By entering, you agree that you are giving Sponsor the right to post your Fan Art Submission on its website and/or public websites where it maintains accounts and you are assigning all ownership and usage rights to your Fan Art Submission to Sponsor in exchange for no compensation of any kind.

5) Judging and Winner Determination: Entries will be judged by a panel of graphic designers and marketers from Sponsor (“Judging Panel”) and will be judged and weighted equally on the following points: (a) creative, fresh, engaging and innovative design; (b) best interpretation of a scene; and (c) degree of design intricacy and/or design “finish.” The Judging Panel will determine forty-five (45) First Place Winners and five (5) Grand Prize Winners. The decisions of the judging panel in all matters relating to this Promotion are final. Judging will be completed on or about December 14, 2011. At Sponsor’s sole discretion, if an inadequate number of entries or entries of inadequate quality are received, Sponsor reserves the right NOT to determine any entries as Grand Prize or First Place Winners or to determine any number of winners fewer than fifty (50).

6) Prizes: Each of the five (5) Grand Prize Winners will receive a digital code for the FREE download of the Sonic CD™ game and a signed, limited edition Japanese soundtrack from the Sonic CD™ game, Approximate Retail Value (“ARV”) $50 USD. Each of the forty-five (45) First Place Winners will receive a digital code for the FREE download of the Sonic CD™ game and a limited edition Japanese soundtrack from the Sonic CD™ game, ARV $50 USD. There are a total of fifty (50) prizes available with a total ARV of $2,500 USD.

7) Prize Awarding – Potential winners will be contacted within (2) business days of the conclusion of judging by the e-mail address and/or phone number associated with their Entry, (“Prize Notification”). Potential winners will be asked to respond within five (5) days with confirmation of prize acceptance and a mailing address for the purposes of prize fulfillment. Failure to respond to the Prize Notification within the stated time period or without the requested information will result in disqualification and forfeiture of the prize. Unclaimed prizes will not be awarded. Acceptance of a prize constitutes permission for Sponsor to use winner’s name and likeness for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law. Prize recipient shall not be permitted to (a) replace his/her designated prize with another prize or item, (b) transfer or assign his/her designated prize to another person, or (c) substitute any prize or prize component for cash. In the event of unavailability, Sponsor reserves the right to substitute a prize of equal or greater value. All federal, state, local, and other taxes on prizes, including any applicable import taxes on prizes, are the sole responsibility of the person accepting the prize.

8 ) General: If, during any period of the Promotion, for reasons beyond the Sponsor’s control (including, but not limited to, tampering or computer virus infection), the Promotion is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Promotion, without liability and to the extent feasible, will determine winners and award prizes among entries received prior to cancellation or modification. Sponsor is not responsible for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. Entries that are incomplete, inaccurate, irregular, or otherwise not in compliance with these Official Rules, are void. All Entrants agree to comply fully with each provision in these Official Rules. Any person attempting to defraud or in any way tamper with this Promotion and any person who does not comply with these Official Rules, will be ineligible for any prize(s) and may be prosecuted to the full extent of the law.
Without in any way limiting, expanding or amending the Terms of Service at http://www.sega.com/legal/terms.php which Terms of Service policy shall remain in full force and effect, if Sponsor is duly notified that any element of an Entrant’s Fan Art Submission infringes upon the rights of another person and/or receives a legally valid request to remove the affected Fan Art Submission because of such infringement, such Fan Art Submission may be removed and disqualified from the Promotion, as Sponsor may determine in its sole discretion. Further, no Entrant will be eligible to receive a prize unless Sponsor determines, in its sole and absolute discretion, that such Entrant’s Fan Art Submission has been or can be sufficiently cleared for legal purposes and such Entrant has complied with the terms of these Official Rules.
Past experience has shown a promotion such as this one may generate similar submissions which closely resemble concepts and ideas developed by the Promotion Entities whether before, during or after the Promotion. Entrants may see a presentation that seemingly incorporates an idea or concept or includes materials similar to that contained in their entry (e.g., Fan Art Submission). Any similarity may be purely coincidental and is always unavoidable in light of the volume of ideas that the Promotion Entities routinely consider in the course of their content development. Consequently, the Promotion Entities must, and have adopted policies and procedures to protect themselves from potential liability and claims and as part of these Official Rules requires all Entrants (and, if eligible minors, their parents or legal guardians) to agree that: (a) the Promotion Entities may use any and all ideas, concepts, material and expression, in whole or in part, submitted or contained in a Promotion entry, or other material you submit, including, without limitation, the Fan Art Submissions and all copyrights and other intellectual property rights therein; and (b) all entries and entry materials (including, without limitation, the Fan Art Submissions) become the property of Sponsor and will not be returned.

9) Right to Use Your Work and Information About You: By participating, you: (a) represent and warrant that your Fan Art Submission is wholly original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) automatically grant to Sponsor a non-exclusive, worldwide, royalty-free, irrevocable license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your Fan Art Submission; (c) agree that upon selection as a winner of any prize, you agree that your Fan Art Submission shall legally be considered a “work made for hire,” with all rights therein, including, without limitation, the exclusive copyright, transferred to and being the property of Sponsor; (d) in the event your Fan Art Submission is considered not to be a “work made for hire,” you irrevocably assign to Sponsor, all right, title, and interest in and to your Fan Art Submission (including, without limitation, the copyright) in any and all media whether now known or hereafter devised, in perpetuity, anywhere in the world, with the right to make any and all uses thereof, including, without limitation, for purposes of advertising or trade; and (e) agree that by entering your Fan Art Submission, you grant to Sponsor the right to sell and otherwise distribute your Fan Art Submission on any of its websites or in any of its products without any compensation. The rights granted under this paragraph shall extend to Sponsor and its indirect and direct parent companies and their respective affiliated companies with respect to all entries and all other submitted materials related to the Promotion, including those submitted by non-winners and winners.

By submitting a Fan Art Submission, you grant to Sponsor, its parent and affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city and state), voice, biographical information, the Fan Art Submission in your entry and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor, its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e mail address, biographical information, or entry. The rights granted under this paragraph shall extend to Sponsor, its parent, and affiliated companies with respect to all Entrants in the Promotion, including non-winners and winners. Sponsor, however, does not have any obligation to use the winning or non-winning entries for any purpose.

10) Release of Liability and Issues of Law: By participating in the Promotion, all Entrants release Sponsor and its indirect and direct parent companies and their respective affiliates, partners, subsidiaries, officers, directors, agents, employees and all entities associated with the development and execution of this Promotion from any and all liability with respect to and in any way arising from (i) participating in this Promotion, (ii) acceptance or use of prizes, (iii) any injury or damage to an Entrant’s or third person’s computer related to or resulting from the Promotion, the Entries and/or its prizes, and (iv) damage to a user’s computer system (including, without limitation, any server failure or lost, delayed or corrupted data or other malfunction) due, either directly or indirectly, to an Entrant’s participation in the Promotion or downloading of information in connection with the Promotion. The Sponsor reserves the right to modify or cancel the Promotion in the event that any portion of any website used to administer any aspect of the Promotion becomes technically corrupted.

All Federal, state and local laws and regulations are applicable. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE PROMOTION AND THE LAWS OF THE STATE OF CALIFORNIA SHALL GOVERN THE PROMOTION. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THOSE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS. Concurso FanArt de Sonic CD™

Reglamento Oficial

NO SE REQUIERE COMPRA PARA INSCRIBIRSE O GANAR.

1) Descripción de la promoción: Sega of America, Inc. (el “Patrocinador”) está ofreciendo el “Concurso de Fan Art de Sonic CD™” (“la Promoción”) y otorgará premios a los ganadores basándose en juzgar entre todos los participantes elegibles según los criterios establecidos en este Reglamento Oficial de la Promoción. La promoción comienza el 11 de Noviembre del 2011 a las 09:00:00 AM hora del Pacifico (“PT”) y la fecha límite para la entrega de los participantes es el 29 de Noviembre del 2011 a las 10:00:00 AM (“Periodo de envío del participante”).

2) Elegibilidad: La Promoción está abierta sólo para los residentes legales de los Estados Unidos Mexicanos que tengan 13 años de edad o más al momento de la entrada. Los empleados funcionarios y directores del Patrocinador, sus matrices, filiales, subsidiarias, divisiones, publicidad, promocionales y agencias de marketing (en conjunto “Entidades de Promoción”) sus familiares directos (padres, hijos, hermanos y cónyuges) y personas que viven en la misma residencia de estos individuos (sean familiares o no), no son elegibles para participar en la Promoción. Promoción nula donde esté prohibido por la ley, norma o reglamento. Todas las leyes federales, estatales, provinciales y locales son aplicables.

3) Creando tu Fan Art para inscribirlo: Crea una original pieza de arte basada en tu escena favorita de Sonic CD™ (Tu inscripción de FanArt). Tu FanArt inscrito debe:

(a) Ser totalmente original, creado por ti, no puede haber sido publicado previamente o aparecer en cualquier otro lugar, no puede contener material con derechos de autor de terceros o de otra manera infringir la propiedad intelectual u otros derechos de un tercero.

(b) Ser adecuado para todo público (no puede ser obsceno o indecente, incluyendo pero no limitándose a desnudos, pornografía, blasfemia o violencia explicita).

(c) No debe contener declaraciones difamatorias (incluyendo pero no limitándose a palabras o símbolos que son ampliamente considerados como ofensivos para las personas de cierta raza, etnia, religión, orientación sexual o nivel socioeconómico).

(d) No debe incluir amenazas a cualquier persona, lugar, empresa, grupo o nación.

(e) No debe invadir la privacidad u otros derechos de cualquier persona, firma o entidad, y no debe violar ninguna ley o reglamento.

4) Como inscribir tu FanArt: Envía un correo electrónico a la dirección saucedo@teamone-la.com y adjuntar en éste tu FanArt como un archivo anexo. En el cuerpo del correo electrónico se debe incluir la siguiente información:

* Nombre y Apellido completos.

* Edad.

* Dirección completa.

* Dirección de correo electrónico.

* Número telefónico incluyendo clave lada.

* Nombre o referencia de tu FanArt.

No hay límite en el número de veces diferentes en el que se puede participar, sin embargo cada presentación de FanArt debe ser nueva y completamente diferente de cualquier presentación anterior que hayas ingresado y debe ser enviada en un nuevo archivo de correo electrónico. Se aclara que hay un límite de un (1) premio por persona.

Al participar, aceptas dar al Patrocinador el derecho a publicar tu presentación de FanArt en su sitio web y/o sitios web públicos en los que dirige las cuentas, así como también le asignas todos los derechos de propiedad y uso de tu FanArt al Patrocinador a cambio de ninguna compensación de ningún tipo.

5) Elección y Determinación del Ganador: Las Presentaciones de FanArt serán juzgadas por un consejo cuyos miembros serán seleccionados por el Patrocinador (“Panel de Jueces”) y serán juzgados y considerados equitativamente bajo los siguientes puntos:

(a) Ser creativo, fresco, diseño innovador y atractivo.

(b) Mejor interpretación de una escena del juego Sonic CD.

(c) Grado de complejidad del diseño y/o diseño “final”.

El Jurado determinará cuarenta y cinco (45) ganadores del primer lugar y cinco (5) ganadores del Gran Premio.

Las decisiones del Jurado en todos los asuntos relacionados con esta Promoción son finales. El Jurado tomará una decisión alrededor del 14 de Diciembre del 2011. A la sola discreción del Patrocinador si un número insuficiente de participantes o que se reciban presentaciones de mala calidad, el Patrocinador se reserva el derecho de seleccionar el primer lugar o para definir cualquier número de los ganadores, menores de cincuenta (50).

6) Premios: Cada uno de los cinco (5) Ganadores del Gran Premio recibirá un código digital para la descarga gratuita del juego “Sonic CD™” y una edición limitada del soundtrack japonés del juego Sonic CD™ autografiado, premios con un Valor Aproximado de Venta de US$50.00. Cada uno de los cuarenta y cinco (45) Ganadores del Primer Lugar recibirá un código digital para la descarga gratuita del juego “Sonic CD™” y una edición limitada del soundtrack Japonés del juego “Sonic CD™” con un Valor Aproximado de Venta (AVR) de $50 Dólares. Hay un total de cincuenta (50) premios disponibles, con un total de Valor Aproximado de Venta de US$2,500.00.

7) Entrega del premio: Los ganadores serán contactados dentro de (2) días hábiles de la conclusión de elección por parte de los jueces por la dirección de correo electrónico y/o número telefónico asociado al participante (“Notificación del Premio”). A los Ganadores Potenciales se les pedirá que respondan dentro de los cinco (5) días con la confirmación de aceptación del premio y una dirección postal a efectos de la entrega del premio. Los premios no reclamados no serán otorgados. La aceptación del premio constituye el permiso para que el Patrocinador utilice el nombre del ganador y semejanza para propósitos publicitarios y promocionales como así lo determine, sin otorgar previo aviso ni compensación adicional, excepto donde esté prohibido por la ley. Al ganador del Premio no se le permitirá:

(a) Sustituir su premio designado con otro premio u objeto.

(b) Transferir o asignar su premio designado a otra persona.

(c) Sustituir cualquier premio o componente del premio por dinero en efectivo.

En el caso de indisponibilidad, el Patrocinador se reserva el derecho de sustituir un premio de igual o mayor valor. Todos los reglamentos estatales, provinciales y otros impuestos sobre los premios son responsabilidad exclusiva de la persona que acepta el premio.

8 ) General: Si, durante cualquier período de la Promoción, por razones fuera del control del Patrocinador (incluyendo pero no limitándose a, alteración o infección por virus de computadora), la Promoción no es capaz de funcionar como estaba previsto, el Patrocinador, a su discreción, se reserva el derecho de cancelar o modificar la Promoción sin responsabilidad y en la medida de los posible, determinar a los ganadores y adjudicar premios entre las presentaciones recibidas antes de la cancelación o modificación. El Patrocinador no es responsable del Internet, mal función del hardware, software, teléfono u otros errores técnicos, averías y retrasos. Las presentaciones que sean incompletas, inexactas, irregulares o que no cumplan con las Reglas Oficiales son nulas. Todos los participantes se comprometen a cumplir plenamente con cada disposición de estas Reglas Oficiales. Cualquier persona que intente defraudar o manipular de cualquier manera con esta Promoción y cualquier persona que no cumpla con estas Reglas Oficiales no será elegible para ningún premio(s) y puede ser procesado con todo el rigor de la ley.

Si el Patrocinador se encuentra debidamente notificado de que cualquier elemento de la presentación FanArt de un participante que infrinja los derechos de otra persona y/o recibe una solicitud de validez legal para eliminar dicha presentación de FanArt, esta participación puede ser eliminada e inhabilitada de la Promoción, el Patrocinador podrá determinar a su entera discreción. Además, un Participante será elegible para recibir un premio a menos que el Patrocinador determine, a su sola y absoluta discreción, que la presentación FanArt del Participante haya sido o pueda ser arreglada lo suficiente para los efectos legales y dicho Participante haya cumplido con los términos de estas reglas Oficiales.

La experiencia ha demostrado que una promoción como esta puede generar presentaciones similares, que se parecen mucho a los conceptos e ideas desarrolladas por las Entidades de Promoción ya sea antes, durante o después de la Promoción.

Los participantes pueden ver una presentación que aparentemente incorpora una idea o concepto o incluye material similar a la contenida en su presentación (por ejemplo, una Presentación de FanArt). Cualquier similitud puede ser pura coincidencia, y siempre es inevitable en vista del volumen de las ideas que las Entidades de Promoción rutinariamente considere en el curso de su desarrollo de contenidos. En consecuencia, las Entidades de Promoción deben y han adoptado políticas y procedimientos para protegerse de las posibles responsabilidades y demandas, y como parte de estas Reglas Oficiales requiere que todos los participantes (y, si los menores de edad elegibles, sus padres o tutores legales) están de acuerdo en que:

 

(a) Las Entidades de Promoción puede usar cualquiera y todas las ideas, conceptos, materiales y expresiones, en todo o en parte, presentada o contenida en una Presentación FanArt de la Promoción, o cualquier otro material que se envíe, incluyendo, sin limitación, las presentaciones de FanArt, derechos de autor y todos los otros derechos de propiedad intelectual sobre el mismo.

(b) Todas las presentaciones y materiales de presentación (incluyendo, sin limitación, las presentaciones de FanArt) pasan a ser propiedad del Patrocinador y no serán devueltos.

 

9) Derecho a usar tu trabajo e información: Al participar:

(a) Declaras y garantizas que tu presentación de FanArt es totalmente original, no ha sido publicada anteriormente, y no incorpora o incluye nada que sea propiedad de un tercero y tu presentación de FanArt no viola ningún derecho de autor, marca registrada, derecho de publicidad, derecho de privacidad o cualquier otro derecho de terceros.

(b) Otorgas automáticamente a el Patrocinador una no exclusiva, mundial, libre de derechos de licencia e irrevocable autorización para utilizar, reproducir, crear trabajos derivados de, modificar, publicar, editar, traducir, distribuir y mostrar tu presentación de FanArt.

(c) De acuerdo en que la selección como ganador de cualquier premio, se acepta que la presentación de FanArt será considerado como un “trabajo por encargo”, con todos los derechos en el, incluyendo, sin limitación, el derecho exclusivo del autor, y transferidos a ser propiedad del Patrocinador.

(d) Se está de acuerdo que tras una selección como ganador de cualquier premio, en el caso de que tu presentación de FanArt, que no es un “trabajo por encargo”, que irrevocablemente le asigna al Patrocinador todos los derechos, títulos e intereses sobre y su presentación de FanArt (incluyendo, sin limitación, los derechos de autor) en cualquier y todos los medios ahora conocidos o desarrollados en un futuro, a perpetuidad, en cualquier parte del mundo, con el derecho de hacer cualquier y todos los usos de los mismo, incluyendo, sin limitación, con fines publicitarios o comerciales.

(e) De acuerdo en que mediante la presentación de una presentación de FanArt, se concede al Patrocinador el derecho de vender y distribuir de otro modo tu presentación de FanArt en cualquiera de sus sitios web o en cualquiera de sus productos sin ningún tipo de compensación.

Sonic CD™ Fan Art Contest

 

THERE IS NO PURCHASE NECESSARY TO PARTICIPATE
IN THIS PROMOTION OR TO WIN ANY PRIZE.

 

(1) Description of Prize Draws SEGA Europe Limited (the “Sponsor”) is offering a “Sonic CD™ Fan Art Contest” (the “Promotion”) and will award prizes based on judging all eligible entries against the criteria established in these Official Promotion Rules The Promotion begins at 17:00 Greenwich Mean Time (“GMT”) on 11^th November 2011 and concludes at 18:00 GMT on 29^th November 2011 (“Promotion Period”).

(2) Eligibility - The Promotion is open to legal residents of The United Kingdom of Great Britain and Northern Ireland (England, Scotland, Wales and Northern Ireland), who are 13 years of age or older at the time of entry. Promotions are void anywhere it is prohibited by law.  Any entrants who are not eligible for the Promotion can be disqualified at the Sponsor’s discretion.  Employees, officers and representatives (and members of their immediate families and those living in the same household of each) of the Sponsor, its parent, subsidiaries, affiliated companies, advertising and promotion agencies, and any other company involved in the design, execution or production of this Promotion are not eligible.

3) Creating your Fan Art Submission: Create an original piece of art based on your favourite scene from Sonic CD™ (your “Fan Art Submission”). Your Fan Art Submission must: (a) be totally original, created by you, cannot be previously published or appear anywhere else and CANNOT contain any third party copyrighted material or otherwise infringe on the intellectual property or other rights of a third party; (b) be suitable for general audiences (i.e., may not be obscene or indecent, including but not limited to nudity, pornography, profanity or gratuitous violence); (c) not contain defamatory statements (including, but not limited to, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group); (d) not include threats to any person, place, business, group or nation; (e) not invade privacy or other rights of any person, firm or entity, and it must not in any other way violate any law or regulation.

4) How to Enter your Fan Art Submission: Send an e-mail to community@sega.co.uk and attach your Fan Art Submission as a file to the e-mail; in the body of the e-mail include the following informational points (your “Entry”):

• Your first and last name;
• Your age;
• Your address;
• Your e-mail address;
• Your telephone number including area code; and
• The name or reference for your Fan Art Submission.

There is no limit to the number of different times you can enter, however, each Fan Art Submission must be new and completely different from any previous Entry you have submitted and each must be submitted as a separate e-mail Entry. There is a limit of one (1) prize per person.

By entering, you agree that you are giving Sponsor the right to post your Fan Art Submission on its website and/or public websites where it maintains accounts and you are assigning all ownership and usage rights to your Fan Art Submission to Sponsor in exchange for no compensation of any kind.

5) Judging and Winner Determination:  Entries will be judged by a panel of graphic designers and marketers from Sponsor (“Judging Panel”) and will be judged and weighted equally on the following points:  (a) creative, fresh, engaging and innovative design; (b) best interpretation of a scene; and (c) degree of design intricacy and/or design “finish.” The Judging Panel will determine forty-five (45) First Place Winners and five (5) Grand Prize Winners. The decisions of the judging panel in all matters relating to this Promotion are final. Judging will be completed on or about 14^th December 2011. At Sponsor’s sole discretion, if an inadequate number of entries or entries of inadequate quality are received, Sponsor reserves the right NOT to determine any entries as Grand Prize or First Place Winners or to determine any number of winners fewer than fifty (50).

6) Prizes: Each of the five (5) Grand Prize Winners will receive a digital code for the FREE download of the Sonic CD™ game and a signed, limited edition Japanese soundtrack from the Sonic CD™ game. Each of the forty-five (45) First Place Winners will receive a digital code for the FREE download of the Sonic CD™ game and a limited edition Japanese soundtrack from the Sonic CD™ game. There are a total of fifty (50) prizes available.

(7) General:
(i) Potential winners will be contacted within two (2) business days of the conclusion of judging by the e-mail address and/or phone number associated with their Entry, (“Prize Notification”).  Potential winners will be asked to respond within five (5) days with confirmation of prize acceptance and other requested information. Failure to respond to the Prize Notification within the stated time period or without the requested information will result in disqualification and forfeiture of the prize. Return of prize notification e-mail as undeliverable will result in disqualification and the selection of an alternate winner. Unclaimed prizes will not be awarded. Acceptance of a prize constitutes permission for Sponsor to use winner’s name and likeness for advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law.

(ii) Prize recipient shall not be permitted to (a) replace his/her designated prize with another prize or item, (b) transfer or assign his/her designated prize to another person, or (c) substitute any prize or prize component for cash. All cash prizes will be issued in GBP Pound Sterling via cheque or bank transfer. In the event of unavailability, Sponsor reserves the right to substitute a prize or prize component of equal or greater value. ANY AND ALL TAX LIABILITY RESULTING FROM A WINNER’S RECEIPT OF THE PRIZE IS THE RESPONSIBILITY OF THE WINNER.

(iii) Sponsor reserves the right to modify or discontinue this Promotion at any time and without notice following the conclusion and complete fulfilment of all prizes associated with any given (and then current) Promotion.  In the event of a dispute regarding the identity of the person submitting the winning entry, the prize will be awarded to the authorised account holder of the submitted Internet e-mail address regardless of the individual who submitted the entry. The authorised account holder is the natural person who is assigned to the e-mail address by an Internet Service Provider or other organisation that is responsible for assigning e-mail addresses or the domain names associated with e-mail addresses. Sponsor reserves the right to void entries, which in its sole determination, are irregular or have been generated with abusive and/or duplicitous intent including but not limited to false or multiple e-mail addresses.

(iv) Without in any way limiting, expanding or amending the Terms of Service at http://www.sega.co.uk/legal/terms.php which Terms of Service policy shall remain in full force and effect, if Sponsor is duly notified that any element of an Entrant’s Fan Art Submission infringes upon the rights of another person and/or receives a legally valid request to remove the affected Fan Art Submission because of such infringement, such Fan Art Submission may be removed and disqualified from the Promotion, as Sponsor may determine in its sole discretion. Further, no Entrant will be eligible to receive a prize unless Sponsor determines, in its sole and absolute discretion, that such Entrant’s Fan Art Submission has been or can be sufficiently cleared for legal purposes and such Entrant has complied with the terms of these Official Rules.

(v) Past experience has shown a promotion such as this one may generate similar submissions which closely resemble concepts and ideas developed by the Promotion Entities whether before, during or after the Promotion. Entrants may see a presentation that seemingly incorporates an idea or concept or includes materials similar to that contained in their entry (e.g., Fan Art Submission). Any similarity may be purely coincidental and is always unavoidable in light of the volume of ideas that the Promotion Entities routinely consider in the course of their content development. Consequently, the Promotion Entities must, and have adopted policies and procedures to protect themselves from potential liability and claims and as part of these Official Rules requires all Entrants (and, if eligible minors, their parents or legal guardians) to agree that: (a) the Promotion Entities may use any and all ideas, concepts, material and expression, in whole or in part, submitted or contained in a Promotion entry, or other material you submit, including, without limitation, the Fan Art Submissions and all copyrights and other intellectual property rights therein; and (b) all entries and entry materials (including, without limitation, the Fan Art Submissions) become the property of Sponsor and will not be returned.

(vi) By entering, you (a) agree to comply with and be bound by the Official Rules and the decisions of the Sponsor which are final and binding in all respects; (b) agree to release Sponsor and its employees and agents from any and all liability, loss, damage or injury resulting from participation in this Promotion or from the awarding, receipt, possession use and/or misuse of any prize; (c) acknowledge that Sponsor, and its employees and agents have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize including, but not limited to, its quality, mechanical condition or fitness for a particular purpose; (d) represent and warrant that your Fan Art Submission is wholly original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (e) automatically grant to Sponsor a non-exclusive, worldwide, royalty-free, irrevocable licence to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute and display your Fan Art Submission; (f) agree that by entering your Fan Art Submission, you grant to Sponsor the right to sell and otherwise distribute your Fan Art Submission on any of its websites or in any of its products without any compensation. The rights granted under this paragraph shall extend to Sponsor and its indirect and direct parent companies and their respective affiliated companies with respect to all entries and all other submitted materials related to the Promotion, including those submitted by non-winners and winners; and (g) grant to Sponsor, its parent and affiliated companies the right, except where prohibited by law, to use your name, likeness, picture, address (city), voice, biographical information, the Fan Art Submission in your entry and written or oral statements, for advertising and promotional purposes in promoting or publicizing Sponsor, its products or services, without compensation unless required by law. You shall have no right of approval, no claim to compensation, and no claim arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city), e‑mail address, biographical information, or entry. The rights granted under this paragraph shall extend to Sponsor, its parent, and affiliated companies with respect to all Entrants in the Promotion, including non-winners and winners. Sponsor, however, does not have any obligation to use the winning or non-winning entries for any purpose.

(vii) The use of machines, computers or any automated technique (“Automated Cheats”) to enter the Promotion is prohibited. Sponsor has the right to invalidate any entry if its sole opinion Registered User has engaged the use of Automated Cheats at any time.  All decisions of the Sponsor are final.

(viii) Sponsor is not responsible for any lost, late, delayed, misdirected, garbled, illegible, incorrect or inaccurate information or entries that are misdirected or misrouted as a result of interrupted or unavailable network connections or internet transmissions for any reason, or any failure of the website during the Promotion Period, or for any computer, phone, phone line hardware or software malfunction, failure or error of any kind, whether mechanical, human or electronic. Any attempt by an entrant to interfere with the operations of this Promotion is a violation of criminal and civil laws; Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law. If, for any reason, any Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion and select winners in a random drawing from among all eligible entries received prior to the cancellation. All entries are the property of the Sponsor.

 

(8) Release: BY PARTICIPATING IN THIS PROMOTION, YOU RELEASE AND HOLD SPONSOR AND ITS PARENT COMPANY OR COMPANIES, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS, RETAILERS, ADVERTISING AGENCIES AND EACH OF THEIR RESPCTIVE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, AND REPRESENTATIVES, HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, DAMAGES, CLAIMS, AND ACTIONS OF ANY KIND ARISING IN CONNECTION WITH THE PROMOTION OR RESULTING FROM ACCEPTANCE, POSSESSION, USE OR MISUSE OF, OR DEFECTS IN, A PRIZE, OR PARTICIPATION IN THE PROMOTION, WITHOUT LIMITATION CLAIMS BASED ON PROPERTY LOSS OR DAMAGE, PUBLICITY OR PRIVACY RIGHTS, AND/OR DEFAMATION. NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT THE SPONSOR’S LIABILITY FOR PERSONAL INJURY OR DEATH CAUSED BY ITS NEGLIGENCE.

(9) Law and Jurisdiction: These terms are governed by English law and any claim or matter arising out of these terms shall be subject to the jurisdiction of the courts of England.
